Privacy Policy

In line with the Personal Data Protection Act 2010 which came into effect on 15th November 2013 (hereinafter referred to as “the Act”) that regulates the processing of personal data in commercial transactions, it applies to Farmbyte Sdn Bhd. hereinafter referred to as “we”, “us”, and “our”) as a data user. For the purpose of this Notice, terms used herein shall have the meanings ascribed to them in the Act.

We treat and view your personal data seriously.

1. Collection of personal data 

We wish to give you notice that your personal data will be collected, recorded, processed, stored, used, transferred and/or disposed by us including our employees to be utilised and dealt with in accordance and in compliance with the Act.

2. Sources of personal data

We collect personal data through several methods which include but are not limited to: -

a) Information or comments that you have provided to us by whatsoever means and/or in a whatsoever manner; and/or

b) Information obtained independently by us or given to us from other lawful sources.

3. Nature of personal data

Your personal data processed by us may include but not limited to, where relevant: -

· Name, date of birth, identity card or passport, name of employer/company, home and office address, telephone/handphone number, facsimile number, e-mail address, occupation, age, gender, marital status, weight, height, photos, race, nationality, religion, family and/or next of kin information, bank details, education background, training attended, working experiences and any other personal data required for the purposes set out in Section 4 of this Notice.

4. Purposes of collecting personal data

We may process your personal data, including any additional information that you may subsequently provide to us, in connection with events/activities organized by us, our digital platform apps and any other matters incidental to it. The purposes of collecting your personal data shall include but not limited to: -

a) for verification of identity;

b) for our internal record;

c) registering, managing and/or administering your use and/or access to our digital platform apps;

d) to perform our core operational services;

e) for identification of your location;

f) for contacting you on matters relating to Farmbyte Sdn Bhd. and any inquiries and/or requests submitted by you through our personnel, agent, or digital platform (if any) or otherwise;

g) for the purposes otherwise notified to you at the point of collection of personal data;

h) to market and promote events/activities organized by us and/or services including sending you electronic announcements, seasonal greetings, invitations, newsletters and provide you with information about our events/activities organized by us and/or services (including by way of SMS, phone call, email, fax, mail, social media or any other reasonable communication channels);

i) to identify you and administer your personal data (including publishing your name and photo) when you participate in events/activities organized by us, and facilitate your participation in our events/activities and our administration of, any events, including meetings, seminars, conferences, talks, road shows, contest, promotions or campaigns;

j) for research, analysis and improvement, including conducting market research or surveys, internal marketing analysis, customer profiling activities, analysis of customer patterns and choices, planning and statistical and trend analysis in relation to our products and/or services;

k) to conduct background search as may be necessary or appropriate;

l) to comply with the compliance of any financial institutions or banks that are related to products and/or businesses of Farmbyte Sdn Bhd. and/or its Group of Companies;

m) for internal investigations, audit or security purposes, compliance with legal and regulatory obligations; and/or

n) for any other purpose that is incidental or in furtherance to the above purposes.

5. Impact resulting from failure to supply personal data

Failure to supply such data by you will result us (shall include but not limited to): -

a) being unable to process any related applications;

b) affect our ability to perform our obligations under any potential or existing services/programs;

c) affect your ability to enjoy the benefits of our program/activities and/or our services; and/or

d) affect our ability to carry out purposes as listed in Section 4 of this Notice.

6. Disclosure to third party

We shall endeavour to safeguard and maintain the confidentiality of your personal data. Kindly take note that certain personal data relating to you may be required to be disclosed to third parties, including but not limited to: -

a) any person to whom we are compelled or required to do so under the law or in relation to any order or judgment of a court, or in response to a competent government agency;

b) any party involved in or related to a legal proceeding (or prospective legal proceeding), for the purposes of the legal proceedings;

c) government agencies, statutory authorities, industry regulators and other similar authorities;

d) our auditors, consultants, accountants, or other financial or professional advisers;

e) our contractors or third-party service or product providers as may be necessary or appropriate;

f) our financial institutions and/or banks;

g) our Group of Companies as incorporated under the Companies Act 2016 and/or incorporated under any other relevant laws; and/or

h) as otherwise permitted under Malaysian law, including without limitation, any laws and regulations as may be prescribed from time to time.

In this regard, we shall endeavour to take all necessary steps to only disclose any relevant personal data to the aforesaid third parties.

7. Safeguards

We shall collect, record, process, store, use, transfer and dispose of your personal data in a secure manner. We endeavour, where practicable, to implement the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to prevent any unauthorised or unlawful processing of your personal data and any accidental loss or destruction of or damage to your personal data.

8. Accuracy of Personal Data

Unless informed otherwise by you, we assume that the information provided to us is accurate, complete, up-to-date, reliable and not misleading, and where applicable, that you have obtained the necessary consent and authorization to disclose such information.

For the avoidance of doubt, we and/or our Group of Companies and/or its employees or authorized officers or agents will not be responsible for any personal data submitted by you to us that is inaccurate, misleading, incomplete and not updated.

9. Your right to access and contact

We will retain your personal data for the period necessary to fulfill the purpose outlined in this Notice unless a longer retention period is permitted or required by law and thereafter the Personal Data shall only be retained for statistics and research purposes. You are responsible for ensuring that the personal data provided is accurate, complete, correct, and up to date. 

If you wish to access and/or make an amendment and/or deletion to your personal data held by us, you may do so by making a written request to us and deliver to our office. In the absence of such a request, we will proceed according to this Notice.

If you wish to withdraw your consent at any time, you may do so by submitting a written request to us and deliver to our office.

10.  Changes to our policy 

Please note that this Notice may be amended from time to time in accordance with applicable laws and regulations without prior notice. Where necessary, we shall provide notice of such amendments via any appropriate means as we may determine.

11.  Version 

This Notice is in Bahasa Malaysia and English. In the event of any inconsistency between the English version and any translation of the Personal Data Protection Notice, this Notice in English shall prevail.
